Terms and Conditions
These Terms and Conditions govern access to and use of the website aureatrade.com (the “Site”), operated by AU Capital Estratégico, S.A. de C.V. under the trade name Aurea Trade Partners (“Aurea”), with its address at Calle 28 de Octubre 107, Col. San Sebastián, Toluca, Estado de México, México. By accessing the Site or using its forms, you accept these Terms. If you do not agree with them, we ask that you not use the Site.
1. Nature of the Site
The Site is for informational purposes. It describes how Aurea evaluates, structures and executes commercial operations, and allows you to submit evaluation requests. The content of the Site does not constitute a binding offer, a quote or a commitment to contract.
Every operation in which Aurea takes part is subject to a prior evaluation, to the verification of the counterparties and to the execution of a written contract that sets out the role of each party, its obligations and its consideration.
2. Evaluation requests
- Submitting the “Evaluate an operation” form does not create any obligation for Aurea or for you.
- Aurea may accept or decline any opportunity at its sole discretion, without having to state its reasons.
- You agree to provide truthful, complete and lawful information, and to have the necessary authorizations to share any third-party information you include.
- Aurea takes part only in operations in which it has a real, defined and documented role. It does not issue invoices for operations in which it does not take part, does not lend its importers’ registry (Padrón de Importadores) or import on behalf of third parties, and does not sign contracts in which it does not have a real operational role.
- Aurea will treat the information in your request confidentially and in accordance with its Privacy Notice. If you require a confidentiality agreement before sharing business-sensitive information, please indicate so in your request.
3. Informational content
The guides, articles, frequently asked questions and other content on the Site are general in nature. They do not constitute legal, tax, customs, accounting or financial advice, and do not replace the opinion of a specialist on your specific case. The cases presented describe Aurea’s experience and way of operating; the results of each operation depend on its own conditions.
We strive to keep the information accurate and up to date, but we do not guarantee that it is free of errors or that it reflects regulatory changes after its publication.
4. Intellectual property
The texts, diagrams, photographs, logos, the Au symbol, the Aurea Trade Partners and The Aurum Group trademarks, as well as the design of the Site, are the property of AU Capital Estratégico, S.A. de C.V. or of the companies of The Aurum Group, or are used with the authorization of their owners. Their reproduction, distribution or modification without prior written authorization is prohibited, except for personal, non-commercial use with attribution of the source.
5. Permitted use
You agree not to use the Site for unlawful purposes; not to submit false or misleading information or information that infringes the rights of third parties; not to attempt to gain unauthorized access to its systems; and not to take actions that affect its operation or security.
6. Third-party links
The Site may include links to third-party sites or services, such as WhatsApp. Aurea does not control and is not responsible for their content, availability or privacy policies.
7. Limitation of liability
The Site is provided “as is” and “as available”. To the extent permitted by law, Aurea will not be liable for damages arising from the use of or inability to use the Site, from decisions made based on its informational content, or from interruptions, errors or viruses not attributable to it.
8. Amendments
Aurea may amend these Terms at any time. Amendments will take effect upon their publication on the Site, indicating the date of the last update.
9. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For their interpretation and performance, the parties submit to the competent courts of the city of Toluca, State of Mexico, and waive any other jurisdiction that may correspond to them by reason of their present or future domicile.
